BANKRUPTCY
- CHAPTER 7 ¿ CHAPTER 13 ¿ FORECLOSURE ¿ REPOSSESSION ¿ GARNISHED WAGES ¿ CREDITOR HARASSMENT
Chapter 7 bankruptcy is often referred to as the liquidation chapter of the bankruptcy code. Under Chapter 7, the debtor surrenders non-exempt assets to the Trustee and at the conclusion of the process most debts are eliminated. Under the bankruptcy reform passed in 2005, debtors must pass a means test in order to qualify to file under Chapter 7.
Chapter 13 is often referred to as the \\"wage earner\\" or \\"personal reorganization\\" bankruptcy. In a Chapter 13 filing, the debtor submits a plan to the bankruptcy court to pay debts over a three to five year period. At the conclusion of the plan, most remaining debts are discharged regardless of whether they have been paid in full. Chapter 13 is often very advantageous for debtors with assets they wish to keep or large amounts of non-dischargeable debt.

Is bankruptcy the best solution to your financial problems? There is no one answer for everyone. It depends on your unique personal circumstances and should only be considered after a thorough investigation into the available alternatives. Your answer will depend on such factors as your age, personal temperment and the type and amount of debts owed. Some debts are not usually dischargeable (e.g. taxes, child support, student loans). Other types of debts may be secured by your assets (e.g. mortgages and auto loans). Bankruptcy laws can be complicated. There are different types of bankruptcies. Each type has different rules and different conditions. At the Law Office of Barry W. Rorex, we offer a free initial consultation to help you make the decision whether or not bankruptcy is the right choice for you and, if so, what you need to know and do to achieve the results offered under the various bankruptcy alternatives. If you are having severe financial problems, facing foreclosure or repossession, or being constantly harassed by creditors, give us a call. (520)495-7596.
