Chapter 7

This is the most common form of Arizona bankruptcy and is most often filed by individuals and couples. This bankruptcy protection is also available to corporations, partnerships, and limited liability companies (LLC's). In Arizona, Chapter 7 bankruptcy proceedings consist of a court-appointed trustee that liquidates your non-exempt assets and divides funds equally between creditors. All remaining debts are then discharged.

Chapter 13

This is typically used by individuals and sole proprietors who do not qualify for, or desire, to file a Chapter 7 bankruptcy. It allows individuals to keep their property and pay off their debt on a schedule over three to five years. Petitioners pay their court-appointed trustee a set amount each month. The trustee then distributes funds to creditors.
